Terms & Conditions

Introductory Offers and Selections: Special offers without obligation are available to applicants who are interested in taking up membership of the Club in which they can receive Regular Selections every four weeks and the annual Best of the Best Collection and other Special Selections (see details below).  Those taking up these offers are not committed to joining the Club or receiving any further Selections. These offers are always subject to acceptance and to stock availability. Delivery of the Introductory Selection is usually within 10 days from receipt of application but such delivery is not guaranteed.  When offered on special terms the Introductory Selection can only be sent to the applicant and not to a third party.  The Introductory Selections are not suitable as gifts in that their purpose is to give applicants the opportunity of deciding whether to continue receiving the regular monthly Chocolate Tasting Club selections and accordingly these will not be supplied on a "pre-cancelled" basis.  The Introductory Selections are available as one-off purchases subject to payment of the full price made at time of ordering. Multiple applications for Introductory Offers will be declined unless the Club has invited a further application.  The Club reserves the right to screen all applications for Introductory offers and reject any requiring  delivery to addresses where it has identified itself or through third parties that delivery problems have occurred previously.  The Club does not undertake to advise of any declined application.

Membership: Membership to the Club occurs after the Introductory Selection has been paid and the member has not cancelled.  Members will receive a membership card approximately two – three weeks after they have paid for the Introductory Selection.  Members are entitled to receive the Regular Selections and Special Collections at members-only prices and receive a 5% discount off Hotel Chocolat goods  within the UK whether purchased online, through catalogues or in Hotel Chocolat stores.

Regular Selections : Every four weeks (and therefore 13 times a year) a completely different selection is created for each of the five types of selection available: Classic (which is also available in the larger version called Trio), All Milk, Dark, Purist and Elements which members can select.  In addition to selecting the type of Selection, Members can also choose how often they receive selections as follows: 4-weekly (standard), 8-weekly, 12-weekly, 13-weekly (ie four times per year), 17-weekly (ie three times a year), 26-weekly (ie twice a year).  Members may also delay any despatch by specifying "beginning, middle or end" of a specific month for despatch of their next delivery.  Delivery of Regular Selections are made as soon as they are available and cannot be specified or guaranteed to be delivered on specific days. Orders may be cancelled if incorrect price due to a typographical error.

Special Collections: members will be offered Special Club collections from time to time. One of which, the Excellence Collection, represents the Best of the Best of the Regular Selections from the previous year and is sent automatically to Members.  Members can also request other Special Collections to sent automatically each year.  Members will be notified by post a few weeks prior to the despatch of Excellence and any other Special Collection they have requested to be delivered each year and may cancel their order for the same subject to giving notice within two weeks of receipt of notification. Orders may be cancelled if incorrect price due to a typographical error.

Additional orders: Members may order additional Regular Selections and Specials subject always to stock availability for which payment may be required to be made at time of ordering.

Delivery:  As a member of the Chocolate Tasting Club your regular boxes and Special Tasting Club Selections are packed and labelled at our Swiss distribution facility in Basel, Switzerland. Please note that you are responsible for complying with all applicable EU and customs trade regulations in respect of the importation of your boxes. This includes the liability for customs duties or import VAT, if applicable. The stated/advertised price, however, includes any import VAT and/or customs duties applicable. We have arranged for CTC Distribution GmbH, a Swiss company whose registered address is: Baarerstrasse 2, 6300 Zug, Switzerland, to act as your direct representative to handle the importation of the boxes into the EU and onward delivery to yourself or your nominated addressee.  If you would prefer another party to handle this service for you please let us know. Your postage and handling charge for your regular selections includes a charge of £3.95 (for Specials the charge is £4.95) a portion which has been paid on your behalf to CTC Distribution GmbH for their services in arranging the importation and delivery to you.

Easy pay/Autodebit:  If you are paying by Easy pay/Autodebit we will securely store your debit credit card details and charge this card with for any further selections you take from the Tasting Club.  You will be charged on despatch of each product rather than point of order.  Your card details will be held in accordance with PCI compliance and we do not have access to the individual card number for fraud-prevention reasons.  Card details will be held until you advise us to have them removed from our database.

Member's details:  The Club undertakes to hold all Members' details securely in accordance with the Data Protection Act and not to release any such details to any third party outside the Hotel Chocolat group of companies.  The Club reserves the right to promote its products to Members using the information supplied by Members and allow the other companies within the Hotel Chocolat group to do the same by all promotional methods save always that Members can at any time decline to receive such material. Members will only receive emails from the Club and other companies within the Hotel Chocolat group of companies if they have specifically given consent.

General:   The Club reserves the right to substitute any chocolates within its Introductory, Regular and Special Selections with that of similar value. The total claim against the Club for any liability whatsoever shall not exceed the price of the goods supplied.  The Club accepts no liability for any consequential loss whether this arises from a breach of duty in contract or in any other way. All trademarks and registrations are acknowledged as belonging to their registered companies.

 

Cancellation by us: We reserve the right to cancel the contract between us if:

1. we have insufficient stock to deliver the products you have ordered.
2. we do not deliver to your area; or
3. one or more of the products you ordered was listed at an incorrect price due to a typographical error.

If we do cancel your contract we will re-credit to your account any sum deducted by us from your credit card as soon as possible but in any event within 30 days of your order. We will not be obliged to offer any additional compensation for disappointment suffered.
